In line with social responsibility, Arterior employs workers with altered working abilities under suitable and appropriate conditions to their qualifications and health status.

Our purpose is to develop the knowledge of such employees, promote their active lifestyle, and create financial security for them.

We support those in disadvantaged situations, our employees with disabilities or impaired working ability, and our employees working as parents raising at least three small children. We offer them the opportunity to use atypical work, such as home office, part-time job, flexible working hours, which can be easily inevitable due to the nature of the tasks.

We intend an outstanding participant in the domestic market dealing with barrier-free design. This mission also assumes that we wish to develop and increase our human resources, even with more employees with altered work abilities.

Arterior Komplex Kft. became an officially accredited employer (sheltered workshop) at the end of 2016. Registration number: 0430-00.

Under § 111 of the Public Procurement Act (Kbt.) the Act shall not apply to the procurement of goods made or services provided by disadvantaged workers, in a sheltered place of employment, the value of which is below EU thresholds.

The preamble of Directive 2014/24/EU (36) states that “employment and occupation contribute to integration in society and are key elements in guaranteeing equal opportunities for all. In this context, sheltered workshops can play a significant role.

The same is true for other social businesses whose main aim is to support the social and professional integration or reintegration of disabled and disadvantaged persons, such as the unemployed, members of disadvantaged minorities or otherwise socially marginalized. However, such workshops or businesses might not be able to obtain contracts under normal conditions of competition. Consequently, it is appropriate to provide that Member States should be able to reserve the right to participate in award procedures for public contracts or for certain lots thereof to such workshops or businesses or reserve performance of contracts to the context of sheltered employment programs.”

 

Protected employment

Based on the Public Procurement Act

‘sheltered place of employment’: employment by an accredited employer on condition that the employer ensures a transit or permanent employment and as a minimum 30% of its employees are deemed to be persons with reduced ability to work pursuant to Article 22 of Act CXCI of 2011 on the benefits of persons with reduced ability to work and on the amendment of certain acts and, in addition, employers which were established with the aim of employing disadvantaged workers.

Based on the Public Procurement Act, procurement can be pursued in an alternative way from protected workplaces.

Reserved Public Contracts

  • 1. Contracting authorities may or, if the Government so provides, shall reserve the right to participate in a public procurement procedure for organizations qualifying as sheltered place of employment, provided 30 % or more of their employees are disadvantaged or disabled workers, furthermore, for developmental employers, provided 30% or more of their employees are involved in developmental employment. Contracting authorities may or, if the Government so provides, shall require that the public contract be performed in the framework of a job creation program, provided at least 30% of the people employed in the course of the performance of the contract are disadvantaged, disabled or handicapped workers (sheltered employment programs). Contracting authorities shall refer to this fact in the contract notice launching the procedure.

2. In the case of contracts that are reserved according to paragraph 1, contracting authorities shall ensure equal rights, where more than 30% of the employees of an economic operator established within the European Union are disadvantaged, handicapped, or disabled workers.

Therefore, within the framework of the public procurement procedure, Bidders can legally reserve their specific procurements for sheltered working places.

In this case, it must be indicated in the notice or the summary information when the procedure is initiated. If the public procurement procedure is announced as reserved, in that case only sheltered working places can make a bid.

Miután e munkavállalók az ajánlattevő által – közvetlenül – bevontan (önállóan vagy alvállalkozóként bevont szervezet munkavállalójaként) is részt vehetnek a szerződés teljesítésében, álláspontunk szerint az ajánlatkérő nem korlátozhatja a Kbt. 29. § szerinti fenntartást az ajánlattevőre (részvételre jelentkezőre).

Kivételek

  • E törvényt nem kell alkalmazni az uniós értékhatárt el nem érő a védett munkahelyen, megváltozott munkaképességű személyek által előállított áruk, vagy teljesített szolgáltatások beszerzésére. A kivételi kör alapján Ajánlatkérőknek lehetőségük van uniós értékhatárt el nem érő beszerzéseiket a közbeszerzés alkalmazása nélkül lefolytatni e paragrafus alapján, amennyiben a beszerzés védett munkahelytől történik.

Értékhatárok:

Minisztériumok, illetve a Kormány által kijelölt központi beszerző szervek (Kbt. 5. § (1) bekezdés a) b) pontja), valamint ezen ajánlatkérők esetében a védelem terén beszerzendő árukra akkor, ha a védelem terén a beszerzendő áru a Kbt. 2. mellékletében (2014/24/EU irányelv III. mellékletében) szerepel, 135 000 euró, azaz 41 427450 forint a Kbt. 5. §a szerinti egyéb ajánlatkérő esetében, valamint a Kbt. 5. § (1) bekezdés a) b) pontjában meghatározott ajánlatkérők esetében, ha védelem terén a beszerzendő áru a Kbt. 2. mellékletében (2014/24/EU irányelv III. mellékletében) nem szerepel, 209 000 euró, azaz 64 135 830 forint közszolgáltatóknál az árubeszerzésre és szolgáltatásnyújtásra irányuló szerződések esetében 418 000 euró, azaz 128 271 660 forint.
